The legal implications of using AI in your online business.

In this episode of the Simple Business Show, I had the pleasure of speaking with attorney and blogger Liz Stapleton about the legal implications of using artificial intelligence (AI) in your online business.
Given the rapid evolution of technology, it’s crucial for online entrepreneurs to understand how to navigate the legal landscape effectively.
Copyright and AI-Generated Content
When using AI to create written content, it is vital to ensure there is significant human authorship involved. If the content generated is not altered significantly and is published as-is, it may not be copyright-protected, meaning anyone could potentially claim it as their own.
Liz explained that if you use AI as an assistant (e.g., generating an outline or a rough draft), and then edit it to make it your own, you can claim copyright protection for the final product.
Moreover, adding a disclosure that describes how you used AI helps clarify authorship and protects your rights.
The Importance of Disclosure
With the introduction of the AI Act in the European Union, there is an increasing emphasis on disclosure regarding AI usage.
For example, when you use AI to generate content for your blog, you need to share that it was created through a combination of AI and human creation.
It's incredibly important to make sure that you're transparent with your audience at all times.
Not only does transparency build trust with your audience but it can also deter people from stealing your content.
She recommended always informing readers if AI played a role in creating your content, thus putting them on notice regarding your copyright claims.
Navigating AI in Visual Content
AI technology extends into image creation, impacting how entrepreneurs protect their visual assets. Liz noted that the courts have ruled AI-generated images are not copyright-protected.
Therefore, if you direct an AI to create an image based on a prompt, that image cannot be claimed as your own.
When using image editing tools powered by AI, the situation is different. If you start with a photograph you took and enhance or modify it with AI, that process may afford you copyright protection for your alterations.
However, be cautious when using AI-generated images for your brand, as these creations may be free for others to use.
Hiring Considerations with AI Tools
As businesses grow and the need for hiring arises, Liz advises caution when using AI tools to screen candidates. There are significant legal and ethical implications at stake, such as discrimination.
Therefore, it’s essential to remain compliant with the AI Act and adhere to best practices in recruitment.
